Determining crew residency and individual social security obligations can be challenging. At this time Non EU-based employers have no obligation to pay employer social security contributions or deduct employee social security from salaries. This is however set to change from 1 July 2017 with France being the first country to apply new legislation.
Up until such time as the new legislation comes into force, the responsibility for social security and income tax liabilities falls to the crew members themselves as outlined in their employment agreements and all salaries are paid gross.
Sarnia Yachts uses the most up-to-date crew employment contracts which are compliant with flag state and the latest marine employment legislation. We can cater for owner-specific contract changes, and also contracts drafted by an owner’s lawyers, provided they meet our minimum criteria.
We screen all new captains and crew before they come on board. This screening includes qualifications, references, resumés and passports to ensure suitability for the position and the yacht’s operation, flag and insurance.
Crew qualifications often have an expiry date so it is vital to monitor their validity. Sarnia Yachts will monitor your crew’s qualifications and notify you of up-and-coming expiration dates to ensure safe manning and compliance.
